Terms of Service

1. Who we are

KolaVid (kolavid.com) is run by Kola Labs Ltd, company number 17087282, registered in England and Wales at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (“KolaVid”, “we”, “us”). These terms apply when you use KolaVid: the website and app, the KolaVid API and MCP server, and the KolaVid browser extensions, Telegram bot, ChatGPT GPT and add-ons for other apps. 2. Your account

• You must be at least 13 years old, or the minimum age to use online services where you live if that is higher.
• Give a real email address and keep your sign-in details safe. You are responsible for what happens in your account.
• Free credits for new accounts are for one person. Making several accounts to collect them again is not allowed, and we may remove credits or close accounts that do.
• You can delete your account at any time by emailing us.

3. Credits, plans and payment

• Making a video uses credits. The app shows what a video will cost before you make it.
• Credits are taken when a video finishes. A video that fails is not charged.
• Paid plans are subscriptions, billed monthly or yearly in advance through Stripe, and renew until you cancel. You can cancel at any time in Billing; your plan stays active until the end of the period you have paid for.
• A plan's credits are for use while the subscription is active. Unused credits expire when the subscription ends.
• Prices can change. We will tell you before a change applies to your subscription, and you can cancel before it does.
• If something went wrong with a payment or a video, email us and we will look at it. Nothing in these terms affects your statutory rights as a consumer.

4. Your content and your videos

• You keep your rights in what you give us (prompts, scripts, documents, links, pictures and audio) and, as far as the law allows, in the videos KolaVid makes for you. You can use your videos for any lawful purpose, including commercial use.
• You give us permission to store and process your content to make, show and improve your videos and to run the service. We don't publish your videos unless you share them or ask us to.
• Only give us content you have the right to use, and that doesn't break anyone else's rights.
• Videos are made with AI. They can contain mistakes, so check the facts, words and pictures before you rely on or publish a video.

5. Acceptable use

Don't use KolaVid to make or share content that:

• is illegal, sexual content involving minors, or sexually explicit;
• harasses, threatens or promotes hatred or violence against people or groups;
• impersonates a real person or organisation, or is meant to deceive (for example fake news or scams);
• infringes copyright, trademarks or other rights.

Don't try to break, overload or get around the limits of the service. We may refuse a request, remove content, or suspend or close an account that breaks these rules.

5a. The API and connected apps

• An API key, or an app you connect by signing in (such as ChatGPT or Claude), acts as your account: the videos it makes use your credits and are yours, under these terms. Keep keys secret; you are responsible for what is done with them. Revoke a key or disconnect an app in Account > API keys.
• Keep to the limits the developer docs describe (one video at a time per account, and the request rate). Don't share keys, resell access to KolaVid, or use the API to collect other people's videos or data.
• We may change the API with notice, and may limit or revoke a key or a connection that breaks these terms or puts the service at risk.

6. The service

We work to keep KolaVid running and improving, but it is provided as it is, and we can't promise it will always be available or free of errors. We may change or stop features. If we stop the service altogether, we will tell paying customers in advance.

7. Liability

We are not liable for losses we could not reasonably foresee, for business losses, or for how you use the videos you make. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud.

8. Affiliate programme

These terms also apply if we approve you as a KolaVid affiliate through our affiliate program:

• You earn the commission shown on the affiliate page (a share of what each person you refer pays in their first months, after tax, discounts and refunds). A person counts as yours if they create an account within 60 days of first opening your link, in the same browser, and had not opened another affiliate's link first.
• Commission becomes payable 30 days after each payment. A refund or chargeback takes back the commission on the money returned, including from later payouts. We pay by hand to the payout email you give us once your payable balance reaches the minimum shown on the affiliate page. You are responsible for any tax on what you earn.
• No commission is paid on your own accounts or accounts made from your own browser. Don't spam, make false claims about KolaVid, pose as KolaVid, or bid on “KolaVid” in search ads.
• We can change the commission terms for payments after the change, and we can pause or end an affiliate account. Commission earned fairly before that is still paid; commission earned by breaking these terms is not.

Inviting friends. Every account also has its own invite link under Account. Invites earn credits, not money. A friend who creates an account through your link gets the extra credits shown there, but only together with the free sign-up minutes. You get the credits shown there once for each friend, when they first pay, for a limited number of friends a month. A refund of that payment takes the credits back, as far as you have not used them. Your own accounts, and accounts made from your own browser, don't count. Credits earned by breaking these terms can be removed, and we can change or end invites for new sign-ups at any time.

10. Changes and law

We will post changes to these terms on this page with a new date, and tell you by email or in the app before a significant change takes effect. These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you keep the protection of your local consumer law and can bring a claim in your local courts.
